Introduction

Welcome to The Wholesaler website. The Wholesaler sells only to legitimate retail stores in Southern Africa that carry products related to craft or scrapbooking. The Wholesaler does not sell to the public, home stores, schools or craft teachers.

Use of The Wholesaler website (thewholesaler.biz) confirms that you have read and accept our terms and conditions, and that you agree to be bound by them.

The Wholesaler reserves the right to update, change, modify or otherwise alter our terms and conditions at any time without prior notice in its sole discretion. Such revisions shall be effective immediately upon notice thereof, and any such notice may be given through any means, including but not limited to posting of the revised terms on thewholesaler.biz website. Use of the website indicates your acceptance of any changes. You are responsible for regularly reviewing these terms of use.

Consumer Protection Act

All retailers that The Wholesaler sells to, undertake to at all times adhere to and comply with the terms and conditions of the Consumer Protection Act 68 of 2008 and indemnify The Wholesaler from any liability in any instance where, the retailer fails to comply with or adhere to the terms and conditions thereof. Furthermore, retailers, undertake to furnish all consumers with the manufacture’s product warranty, the terms and conditions whereof shall apply except where in conflict with any current or future South African law.

Third-party Websites

As a convenience only, this website may contain links to other websites belonging to or operated by third parties. By making these links available, we are not endorsing third-party websites, their content, products, services or the owners of these third-party websites.

It is your responsibility to make sure that you obtain any information which may be relevant to making a decision, and that you read the privacy and security policy on such third-party websites. We have no control over third-party websites and will not be liable for any loss or damage you suffer, whether directly or indirectly, as a result of your use of third-party websites. You agree that where you access third party websites you do so entirely at your own risk.

However, The Wholesaler seeks to protect the integrity of its website and the links placed upon it, and therefore requests any feedback on not only our website but also the third-party website.

Electronic Products

Warranty

All electronic products sold by The Wholesaler have a 1 Year Limited Warranty. This hardware warranty specifically covers factory faults relating to the machine, power cord and adapter and/or USB cord. Should any of these hardware components test as faulty within the first year of ownership (as determined by the original purchase date), the product or part thereof will be replaced. Any damage caused to an electronic product by a user will render the Warranty null and void. Generally issues experienced with electronic products are related to improper operation. Please utilise the resources available and ensure that you understand how to correctly operate your product.

All electronic products must be registered by end users on www.thewholesaler.biz within 14 days of purchase, in order to activate the 1 Year Warranty. Only products with a serial number from The Wholesaler can be registered on our website. Please note that it remains the responsibility of the store, to explain the importance of the 1 Year Warranty and registration process to the end user.

How to activate the 1 Year Warranty.

  • Go to www.thewholesaler.biz/Product_Warranty.
  • From the menu you will find the "Warranty" under the "About Us" tab.
  • Complete all information fields and submit the form.
  • A date of purchase that corresponds with proof of purchase needs to be supplied in order for the Warranty to be valid.
  • Once the Warranty has been approved by The Wholesaler, both the end user and the store where the product was purchased will receive an email stating that the 1 Year Warranty has been activated.
  • The end user must retain proof of purchase in order to validate the Warranty.

Faulty Electronic Products

  • In the event of a product being faulty and still under warranty, a consumer should contact the store where the product was purchased and explain the nature of the problem.
  • The product must be returned in the original packaging, together with power supply, cutting mats, blades and instruction manuals and proof of purchase.
  • The Wholesaler does not deal directly with the public, and thus all queries should be directed to retailers.
  • We suggest that retailers test the product in order to establish if there is in fact a problem and to avoid unnecessary courier costs.
  • Once a retailer is convinced that a product is faulty, please contact The Wholesaler and arrange to have the product collected for further testing. Please ensure that proof of when the product was sold to the end user is included together with The Wholesaler invoice number upon which the product was purchased. Please also include the original packaging, power supply, cutting mats, blades, cartridges and instruction manuals.
  • The Wholesaler will cover the courier costs of collecting the product from the store however, should the product prove to function correctly, then the courier costs will be for the store’s account.
  • Please allow 5-7 working days for testing of products.
  • Once the product has been tested The Wholesaler will inform the store of the outcome. Should the test results show that the product is faulty and the product falls within the 1 Year Warranty, the store will be credited for the faulty product and re-invoiced for a replacement product.
  • At no time during this process will The Wholesaler communicate directly with the end user. It remains the store’s responsibility to deal with the end user.

Repairs

The Wholesaler does not offer any repairs on electronic products.

Guest Users (General Public)

Retail Orders
  • Please note that The Wholesaler offers retail online ordering as a service to both the public and to retail stores.
  • Retail orders placed on this site by the public function purely as a referral to the selected retail store.
  • The Wholesaler does not deal directly with the public and is in no way responsible for processing retail orders placed on this website.
  • Furthermore, The Wholesaler is not responsible for any direct or indirect damages or losses resulting from the public placing orders online.
Store Locator
  • Please note that The Wholesaler offers a store locator service to the general public. The store locator is a listing of retail & online stores across Southern Africa and purely a referral system.
  • The Wholesaler is not responsible for any direct or indirect damages or losses resulting from the dealings resulting from the store locator referrals.

Competitions
  • The Wholesaler may advertise competitions on our website that are open to the public.
  • The rules & terms for each competition will be clearly stated on each competition campaign.
  • When entering a competition, you agree to be automatically subscribed to our mailing list.
  • The Wholesaler reserves the right to amend competition rules at any time. The Wholesaler may also create rules which will apply to a specific competition only. If we do this we will publish the amended competition rules and/or specific competition rules on the relevant competition page.

Registered Users (Retail Stores)

New Wholesale Customers

Please complete the online registration form here. Once your application has been processed and approved, you will be contacted with a user name and password that will allow you to place orders online.

The Wholesaler reserves the right to suspend or terminate, at our discretion, a registered user's account for violations of our rules, guidelines, or terms and conditions. Equally, the decision to accept or decline any store application, is at the discretion of The Wholesaler.

It remains your responsibility to ensure that all your details are correct and updated on our website. The Wholesaler’s store locator (click here to view) allows the general public to find your store from our website. We reserve the right to remove stores from the Store Locator should we feel that any information is misleading.

Retail Stores (Brick and Mortar)

The Wholesaler sells only to legitimate brick and mortar retail stores that operate from commercial premises in Southern Africa and that carry products related to craft or scrapbooking.

Online Stores

The Wholesaler sells only to online stores that meet the following criteria:

  • Professional ecommerce website with shopping cart and secure payment gateway (exceptions to this at The Wholesaler’s discretion).
  • Established business and brand identity.
  • Good variety of paper craft products published on the website including all products purchased from The Wholesaler. If products purchased from The Wholesaler are not listed on the website, account will be closed with immediate effect.
  • It is encouraged and permissible to display a link on the website to The Wholesaler’s website and to promote The Wholesaler’s retail ordering function which allows a consumer to place an order directly on The Wholesaler’s website and to select a store of their choice to process the order. However, a link of this nature is only permissible given that The Wholesaler’s products are also displayed on the website. It is entirely unacceptable to rely solely on The Wholesaler website for all trade.
  • Marketing on social media is encouraged; however the main trading platform must remain the website that the account was opened for. Should the main source of trade be found to be Facebook, WhatsApp, sms, Gumtree etc. the account will be closed with immediate effect.
  • No home store. It is permissible for the online store to operate from a residential property as long as all product is sold through the website and the Post Office or a courier company is used for all consumer deliveries. No local collections from online stores operating from a residential property are permissible.
  • Minimum monthly orders R5000
  • No classes to be conducted at premises of online stores that operate in a residential area (exceptions to this at The Wholesaler’s discretion). Online store owners are free to teach classes at any other venue of their choice. Product however cannot be sold at classes. People attending the class should receive a kit as part of their class fee. Classes should be advertised and booked from the website. Please note, that should teaching classes become the main form of trade, the account will be closed as The Wholesaler does not supply teachers.
Kit Clubs

The Wholesaler sells only to online kit clubs that meet the following criteria:

  • Professional ecommerce website with shopping cart and secure payment gateway and/or subscription option.
  • Established business and brand identity.
  • All kits and all other products sold must be displayed on the website.
  • Marketing on social media is encouraged; however the main trading platform must remain the website that the account was opened for. Should the main source of trade be found to be Facebook, WhatsApp, sms, Gumtree etc. your account will be closed with immediate effect.
  • No home store. It is permissible for the kit club to operate from a residential property as long as all product is sold through the website and the Post Office or courier company is used for all consumer deliveries. No local collections from kit clubs operating from a residential property are permissible.
  • Minimum monthly orders R5000
  • No classes to be conducted at premises of kit clubs that operate in a residential area (exceptions to this at The Wholesaler’s discretion). Kit club owners are free to teach classes at any other venue of their choice. Orders
  • We only accept orders placed on our website.
  • Minimum opening order: R5000
  • Minimum re-order: R1000 – orders under R1000 will be cancelled.
  • Please note that no orders can be consolidated. All orders received on our website, will be picked, packed and shipped separately.
  • Once you order has been confirmed on our website, you are not be able to make any changes to your order.
  • Please ensure that you pay for your order within 5 calendar days of receiving your invoice. Unpaid orders will be cancelled after 5 calendar days.
  • Order lead time is 2-4 working days.
  • All orders will be picked and packed first in, first out.
  • Please note that should our distribution centre identify any stock shortages on your order prior to shipping, a credit note will be issued for the items that failed to ship.
  • The Wholesaler does not offer cash refunds on stock shortages or discrepancies.
Payment
  • All wholesale prices exclude VAT and are subject to change.
  • This is not an e-commerce website. Payment options include EFT, Cash Direct Deposit, Visa, Master Card and Debit Cards.
  • Please note that no Cheques or Cheque Direct Deposits will be accepted under any circumstances.
  • All orders need to be paid in full before they will be released from our warehouse. Please email a bank generated proof of payment to info@thewholesaler.biz.
  • Orders will only be released upon receipt of proof of payment.
Freight

Your order will be sent with the courier option that you select ie Aramex, The Courier Guy or Collect (your own courier).

No collections at our distribution centre by private individuals or stores.

Please contact us at info@thewholesaler.biz to arrange for your courier to collect from our distribution centre. Please note that we will not be able to provide you with the weight and dimensions of your order. Your courier will have to calculate your shipping costs once they have collected your parcel.

The Wholesaler is not able to provide freight quotes for Aramex Express Courier or The Courier Guy. Aramex and The Courier Guy freight charges will be calculated once your order has shipped. Should you agree to your goods being moved by Aramex or The Courier Guy, you will be liable for the full freight charge as calculated and charged by Aramex or The Courier Guy.

All Aramex and The Courier Guy freight charges will be invoiced separately by The Wholesaler. Should you fail to settle a freight invoice, your account will remain suspended until the freight invoice has been paid.

It is the responsibility of all customers of The Wholesaler to ensure that their delivery address and contact numbers are correct on The Wholesaler’s website.

Additional charges as determined by Aramex and The Courier Guy, will be billed to customers for failed and repeat deliveries due to incorrect address details, lack of contact numbers or unavailability.

Courier lead times range from 24-72 hours.

Please note that it is the customer’s responsibility to request insurance on freight.

The Wholesaler does not send orders through the postal service.

Freight charges are Ex Works (The Wholesaler Distribution Centre). The Wholesaler is not liable for any damages, losses or delays from when the goods leave the distribution centre.

Claims

Please count all boxes before signing for goods from The Wholesaler via any courier. Contact The Wholesaler, within 7 days of receipt of merchandise, regarding any shortage caused by The Wholesaler. Click here to contact us..

Strictly no returns other than in the case of damaged goods, in which instance the damaged item must be returned in its’ original packaging to The Wholesaler accompanied by the original invoice number. No credits will be issued unless the correct invoice number linked to the faulty product is supplied.

For merchandise damaged in transit, please contact the relevant freight company to inspect the goods and to file a freight claim.

Consumer Protection Act

Promotions & Sales

The Wholesaler runs promotions/sales from time to time, as determined by Management. The date of onset of a particular promotion/sale will not necessarily be advertised prior to the day that the promotion begins. Should you have ordered product prior to the onset of a promotion/sale and that product is subsequently placed on promotion/sale, you will not have the right to claim the promotional/sale discount on product already purchased, to return the already purchased product or to request a refund. Promotional discounts, reduced prices and giveaways are exclusively awarded to customers who purchase product whilst any given promotion/sale is actively running.

Promotions/sales will either run for a specific period of time, as advertised on our website or while stocks last. Once a promotion/sale has ended, due to either stock having been depleted or the time period of the promotion/sale elapsing, no further discounts on the products that were on promotion/sale will be available to any customer.

All promotions/sale will be advertised on our website and via email, enabling all customers to benefit from them.

Specific terms may apply to certain promotions/sales in which case these terms will be clearly stated.

Pre-Orders

Although we will do our very best to supply you with all the products ordered on any pre-order promotion, The Wholesaler will in no way be responsible for any items that are out of stock with our suppliers. In the instance of product not shipping from our suppliers, the relevant items will be removed from your pre-order.

Pre-order promotions cannot be cancelled after the closing date of the promotion. Thereafter, the customer is liable for all pre-orders placed.
